There are a few ways to search for probate court records in Ocean County. The Surrogate's Court keeps indexes and dockets for all estates. You can search by the name of the person who died, the date of death, or a case number. Staff at the office can run these searches for you in person or over the phone.

The New Jersey State Archives holds a large set of old Ocean County probate court records on microfilm. The State Archives database lets you look up records online before visiting in person. Ocean County Probate Filing Process

Filing for probate in Ocean County takes less than an hour in most cases. Walk in on any business day. The process is the same as in all New Jersey counties.

Under N.J.S.A. 3B:3-22, there is a 10-day wait after the date of death before a will can be filed for probate. This law applies in Ocean County and across the state. Once those 10 days pass, you bring the will and other papers to the Surrogate's Court. The filing process under N.J.S.A. 3B:3-19 then begins. The court reviews the will and, if all is in order, issues letters testamentary to the named executor.

The State Archives holds Monmouth County probate court records that go back to 1695. These include records for the area that later became Ocean County. The Estate Index for Monmouth County covers 1800 to 1969 and is a good place to start a search for pre-1850 Ocean County estates.

Note: The split between Monmouth and Ocean County was clean. All records filed before February 15, 1850 stayed with Monmouth County.
